AQUA RESORT Regulations
Dear Sir or Madam, the Aqua Resort Management highly appreciates your cooperation in adhering to these regulations. They intend to ensure a peaceful and safe stay for our guests. This page contains the regulations applicable to service contracts concluded by Aqua Resort with the client, who, upon conclusion of the contract, becomes a guest of the resort. A service contract is deemed concluded upon receipt of payment. Before concluding a service contract, please read these regulations carefully. The services provided by Aqua Resort include: accommodation, catering, entertainment, internet, recreation and relaxation, and tourism.
§1
1. Aqua Resort in Międzyzdroje is a year-round resort and is open 24 hours a day, 7 days a week.
2. Rooms are rented on a per-night basis.
3. The overnight stay begins at 4:00 p.m. and ends at 11:00 a.m. the following day.
4. Guests must specify the length of their stay and settle the balance on the day of arrival. Payment in arrears is possible after pre-authorization of the credit card on the day of arrival.
5. If the guest did not specify the duration of their stay when renting a room, it is assumed that the room was rented for one night.
6. Hotel guests are required to register with an ID card or passport.
§2
1. Guests should notify the Reception Desk if they wish to extend their stay beyond the period indicated on the day of arrival by 7:00 PM on the day before their stay expires.
2. The property will accommodate requests to extend your stay subject to room availability.
3. Extending your overnight stay will incur a charge of half the standard nightly rate per additional night. Extending the hotel night beyond 8 hours will be considered as renting the room for an additional night, charged at the current room rate, unless the Property and the Guest agree on individual terms for the extension.
§3
1. Guests may not transfer the room to other people, even if the period for which they paid for the stay has not expired.
2. Unregistered Guests may stay in the room from 9:00 AM to 10:00 PM. After 10:00 PM, guests must register additional guests staying in the room. The Guest who rented the room is responsible for registering the additional guest. Registering an additional guest will incur the associated costs, in accordance with the applicable price list.
3. The resort may refuse to accept a guest who, during a previous stay, grossly violated the regulations, caused damage to the property of the resort or other guests, or caused personal injury to guests, resort employees or other persons staying at the resort, or otherwise disturbed the peaceful stay of guests or the functioning of the rooms at Aqua Resort.
§4
1. The resort provides services in accordance with its category and standard. Guests are asked to report any concerns regarding the quality of services to the reception desk as soon as possible, which will allow the property to immediately respond and remedy any deficiencies or errors.
2. The resort is obliged to provide:
a. Suitable conditions for the Guest’s full and unhindered relaxation;
b. Safe stay, including the security of maintaining the confidentiality of information about the Guest, unless authorized law enforcement authorities request the disclosure of data about persons staying at the Resort;
c. Professional and courteous service in all services provided at the Resort;
d. Cleaning the room and carrying out any necessary repairs to the equipment during the Guest’s absence;
e. Technically efficient service; in the event of faults that cannot be repaired, the Property will make every effort to change the room if possible or otherwise mitigate the inconvenience.
§5
1. At the Guest’s request, the Property provides the following services free of charge:
a. Providing information related to the stay and travel as well as additional attractions of the stay;
b. Luggage storage (The property may refuse to accept luggage for storage on dates other than the guest's stay and items that do not have the characteristics of personal luggage);
c. Safe storage of valuables at reception.
§6
1. The resort is liable for the loss or damage of items brought in by persons using its services to the extent specified in Articles 546 – 852 of the Civil Code, unless the parties have agreed otherwise (e.g. through the provisions of these regulations or the parking regulations);
2. The Guest should notify the Reception about any damage immediately after it is discovered;
3. Valuables should be placed in the safe or deposited at the reception desk. The property is not responsible for valuables not left in the safe or deposited at the reception desk.
§7
1. The resort is not responsible for damage or loss of a car or other vehicle belonging to the Guest if it is left in a place other than the parking lot.
2. The rules for using the parking lot at Aqua Resort are outlined in the Parking Regulations.
§8
1. Quiet hours are required in the resort from 10:00 PM to 7:00 AM the following day;
2. The behaviour of Guests and those using the resort’s services should not disrupt the peaceful stay of other Guests. The resort may not immediately refuse to continue providing services to anyone who violates this rule. Guests who violate this rule shall first be warned of the possible consequences of further behaviour in violation of the regulations.
§9
1. Each time a Guest leaves their room, they should check that the entrance door is securely locked. Apartments are accessed using magnetic cards programmed and issued at the reception desk during check-in. In the event of a lost card, the Guest is asked to immediately report it to the reception desk. The reception desk can issue a duplicate magnetic card and block the lost card.
2. The Guest is financially liable for any damage or destruction of the resorts’ equipment and technical devices resulting from his or her fault or the fault of the Guest’s visitors.
3. For fire safety reasons, it is prohibited to use heaters, electric irons and other similar devices that are not part of the permanent equipment of the Room in hotel rooms.
§10
Personal belongings left in the room by a departing Guest will be sent to the address provided by the Guest. Failure to do so will result in the Property storing these items for a period of three months.
§11
The property allows pets to stay in the Guest’s hotel room for an additional fee of PLN 90 gross/overnight stay/ each.
§12
1. Guests are required to use the room’s equipment properly and only for its intended purpose. In case of damage caused by improper use, the Guest is financially responsible for any damaged or destroyed items and must cover the costs of repair or replacement.
2. The costs of damage in the room will be assessed individually by external companies specializing in the specific type of damaged items.
§13
Guests, as well as any persons for whom they are responsible, agree not to smoke in the rooms. Smoking is strictly prohibited throughout the property. Failure to comply with this ban may result in a penalty of PLN 1,000 per offense.
§14
Children under 13 years of age must be under the constant care and supervision of adults throughout their stay at Aqua Resort. Their legal guardians are responsible for their behaviour, including any damage or injuries caused.
§ 11. RULES FOR USING THE FITNESS ZONE
1. The Fitness Zone (group classes) is an integral part of the Aquapark Facility, and the provisions of the General Facility Regulations as well as these Regulations apply to it.
2. Group classes are held in accordance with the approved schedule.
3. The fitness zone may be used by persons who are at least 17 years of age, hold a valid admission ticket or pass, and have familiarised themselves with these Regulations.
4. Persons participating in group classes declare that they have no health contraindications to performing physical exercise and participate at their own risk. Persons with health issues should consult a doctor before starting exercise.
5. A strict prohibition applies in the fitness zone on smoking tobacco or electronic cigarettes, consuming alcohol, using intoxicating substances or drugs, and selling any pharmaceuticals. Persons who fail to comply with the above provisions may be required to leave the Facility; in such cases, they are not entitled to claim a refund for the purchased ticket or pass.
6. Persons exercising during organised classes bear full responsibility for any damage caused by them in the fitness rooms. For any damage to property located in the fitness rooms and for any intentional actions to the detriment of the fitness zone, the Client shall be legally and financially liable.
7. Entry to organised classes is permitted only in appropriate, complete sports attire and clean, changed sports footwear.
8. The instructor has the right to refuse entry to classes to persons without appropriate sports attire, in particular clean, changed sports footwear.
9. Entry to the fitness zone is granted on the basis of an ESOK transponder.
10. A class reservation system applies in the fitness zone.
11. Persons holding a ticket or pass who have reserved a place in selected fitness classes must report to reception no later than 10 minutes before the class begins. If a person fails to report to reception, their reservation will be forfeited in favour of a waiting person.
12. A reserved class may be cancelled no later than 4 hours before the scheduled start time, and in the case of morning and late-morning classes, by 8:00 p.m. on the preceding day.
13. The Facility Staff reserve the right to change the date or instructor of a given class, as well as to cancel scheduled classes (with appropriate advance notice).
1. Use of the sauna zone is permitted only for persons over 17 years of age and in good health. By entering the sauna zone, the Guest confirms that their health condition allows them to use this form of recreation.
2. Access to the saunas is prohibited in particular for persons:
a) under the influence of alcohol, under the influence of psychoactive substances or other intoxicating agents,
b) with infectious skin diseases,
c) with infections,
d) with viral (e.g. influenza) or bacterial infections,
e) with tuberculosis,
f) with conditions involving sudden attacks, such as epilepsy,
g) during the first three months following a stroke,
h) with inflammation of the veins,
i) with disorders of the circulatory system.
IMPORTANT: women during menstruation and pregnant women should not use saunas or steam baths, as this may pose a risk to their health.
3. Each Guest using the sauna zone must have flip-flops, a towel, or a pareo. The sauna zone is a textile-free area. This means that persons entering this area must remove their swimwear and cover themselves with a towel. Remaining naked in communication areas and relaxation zones is prohibited. Being naked is permitted in sauna cabins and steam baths, provided that intimate areas are covered. Flip-flops and bathrobes must be left outside the sauna or steam bath cabin. For hygiene reasons, the entire body, including the feet, must be placed on a towel in the sauna so that no part of the body comes into direct contact with the wooden surfaces.
4. Bringing in and using mobile phones and recording devices in the sauna area is prohibited.
5. Only Facility Personnel may operate the saunas and the equipment located within them.
6. The use of any personal liquids, emulsions, oils, or other substances in steam baths or saunas is prohibited, as is touching the heat supply installations.
7. Placing any objects (e.g. towels, pareos) near or on the heater is prohibited.
8. Bringing in and consuming personal food in the sauna zone is prohibited.
9. To ensure hygiene, the Guest must take a shower before entering the sauna and after using it. Before entering the sauna, all metal jewellery (e.g. gold, silver) must be removed.
10. Sauna sessions may be conducted only by authorised persons. Rules for participation in sauna ceremonies, special sessions, and sauna evenings:
a) sauna ceremony – a treatment in a dry sauna using specially prepared aromatic substances (e.g. oils, concentrates, resins), conducted by a sauna master who distributes steam and warm air throughout the sauna cabin. Participation in a ceremony depends on the order of entry,
b) special ceremonies – an advanced treatment in a dry sauna or steam bath using specially prepared aromatic substances (oils, concentrates, resins), conducted by a sauna master who distributes steam and warm air throughout the sauna cabin, with the additional use of cosmetic products. The session is subject to an additional fee,
c) sauna evenings – a type of several-hour sauna ceremony conducted by a sauna master, who ensures the comfort and safety of participants. Sauna evenings are themed; therefore, during the dry sauna ceremony, the sauna master presents stories related to the main theme of the event. Additionally, between steam bath sessions, Guests may use body scrubs and cosmetic products. During sauna evenings, snacks prepared by the Facility Personnel are also available to Guests. Duration of a sauna evening – up to 4 (four) hours. Sauna evenings are events for adults only. Limited number of places; prior reservation is required.
§ 10. RULES FOR USING THE GYM ZONE
1. Use of the gym is permitted after familiarising oneself with these Regulations.
2. The gym is open daily from 10:00 a.m. to 9:00 p.m.
3. The gym is available to hotel Guests as part of the fee paid for their stay and only during the paid hotel day, and to external users after prior payment of the fee specified in the Price List.
4. The right to use the gym is granted to Guests and individual clients who are at least 17 years of age.
5. Sports attire and clean indoor sports footwear are required in the gym.
6. Before starting a workout, the Guest must disinfect their hands using the disinfectant provided.
7. Bringing in and consuming food and beverages is prohibited, except for water.
8. The following is prohibited in the gym area:
a) running (this does not apply to treadmills),
b) using equipment and training devices in a manner inconsistent with their intended purpose,
c) bringing in items that pose a risk to users’ health (in particular sharp tools, glass containers, cans, etc.),
d) entering or remaining in the gym by persons under the influence of alcohol or intoxicating or psychoactive substances,
e) damaging gym equipment,
f) littering or contaminating the premises,
g) smoking tobacco,
h) bringing in items that obstruct movement within the Facility.
9. After each use, the Guest must wipe down training equipment using the disposable towels and disinfectant available in the gym.
10. Guests must use the rooms, devices, and equipment provided in the fitness zone in accordance with their intended purpose. The Operator is not responsible for damage caused by the Guest and attributable to the Guest’s actions, in particular resulting from using equipment in a manner inconsistent with its intended purpose, including contrary to operating instructions or instructions given by Facility Personnel.
11. Guests are responsible for any damage to training equipment and machines caused by their fault, in particular resulting from the Guest’s failure to familiarise themselves with the operating instructions for the equipment or machines, or from improper use.
§ 1. GENERAL PROVISIONS
1. The Aquapark facility located at Bosmańska Street 1 in Międzyzdroje is managed by the company operating under the business name HM sp. z o.o., with its registered office in Piaseczno (05-500), at Pawia Street 7, unit 96, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register, under number KRS 1094353, NIP 1231298655, REGON 361559443, with a share capital of PLN 385,000.00(“Operator”).
2. The Aquapark Facility is intended for relaxation, entertainment, and recreation for all guests. The purpose of these Terms and Conditions and other regulations governing the use of the Facility is to ensure the safety of people (guests, employees, and other persons) and property, to maintain order and cleanliness within the Facility, and to set out the rights and obligations of the Operator and the Guests, including the rules on liability.
3. By using the Facility, the Guest confirms that they have read and accepted these Terms and Conditions.
§ 2. DEFINITIONS
For the purposes of these Terms and Conditions and other provisions related to the Aquapark, the following terms have the meanings set out below:
1) “Guest” – means any person who holds a ticket purchased in accordance with the procedure specified by the Operator or who is otherwise authorised by the Operator to enter the Facility on another basis, excluding construction contractors, subcontractors, and other entities providing specific services to the Operator, as well as any person registered as a guest of the Aqua Resort hotel and using the Facility;
2) “Facility Regulations” – means these Terms and Conditions, available on the Facility premises and on the Facility’s website;
3) “Operator” – means the company operating under the business name HM sp. z o.o., with its registered office in Piaseczno.
4) “Price List” – means a document setting out, inter alia, admission ticket prices, special offers, and the prices of certain additional services, available at the ticket offices and on the Facility’s website;
5) “Facility Staff”, “Personnel” – means employees, representatives of the Operator, the Operator’s management, and other members of the Facility staff;
6) “Aquapark Facility” or “Facility” – means the facility located at Bosmańska Street 1 in Międzyzdroje, including the building and the adjacent outdoor areas (including the car park).
7) “Zone” – means the water recreation zone, the sauna zone, the fitness and gym zone, and the wellness & spa zone.
§ 3. GENERAL RULES FOR USING THE FACILITY
1. The Facility is open daily from 8.00 to 22.00 during the summer season, i.e. from June to September, and from 11.00 to 21.00 during the winter season, i.e. from October to May, except in the event of breakdowns or maintenance and repair closures.
2. Information about any change to the Facility’s opening hours will be posted at the ticket offices.
3. In justified circumstances, the Facility Personnel may temporarily restrict access to the Facility, for example if the maximum number of persons using the Facility is exceeded.
4. Before entering and using the Facility, each person must read these Terms and Conditions and comply with them throughout their stay on the Facility premises. Each Guest must also comply with:
a) prohibitions and requirements shown on information boards or signs placed on the Facility premises,
b) instructions and orders of the Facility Personnel intended to ensure safety and order on the Facility premises, including instructions given by on-duty lifeguards,
c) generally applicable provisions of law. Guests must also comply with supplementary regulations concerning the use of individual zones, infrastructure, and attractions (swimming pools, slides, saunas, SPA, gym zone, fitness zone, etc.).
5. If there are any doubts regarding these Terms and Conditions or the use of any zones, attractions, or services of the Facility, the Guest should contact the Facility Personnel.
§ 4. PAYMENT RULES
1. To use the services of the Facility, the Guest must purchase a ticket, hold a valid pass, or be a registered guest of the Aqua Resort hotel. Tickets may be purchased at the ticket offices located in the main hall of the Facility on the ground floor and the second floor. Information on the availability of individual zones and attractions is displayed at the ticket offices.
2. Opening hours are set out in the current offer of the Facility. The last entry to a given zone is possible no later than 40 minutes before its closing time. The closing time of a given zone marks the time by which the Guest must leave that zone via the exit ticket offices or self-service terminals. The Guest must proceed to the changing room area 20 minutes before the closing time of the zone they are using.
3. The fee for the selected offer is charged in advance before entering a given zone, in accordance with the applicable Price List. If the declared duration of stay is exceeded, the Guest must pay an additional fee in accordance with the applicable Price List.
4. The time spent in the Facility is calculated from the moment the transponder is activated and ends when the Guest returns the transponder at the exit gates when leaving the Facility.
5. The Guest must keep the receipt or other proof of ticket purchase from the moment it is issued at the ticket office until leaving the Facility.
6. After payment, the Guest receives a transponder (data carrier), which serves as a lock for the clothing locker. The transponder also allows the Guest to use additional attractions and services. By using additional attractions or services, the Guest accepts their price and agrees to pay for them by placing the transponder against the appropriate terminal. After finishing using the Facility, the Guest must pay the amount recorded on their transponder. Each transponder has an internal limit of funds available for use. For an adult, the limit is PLN 500; for children and young people aged 13 to 18, the limit is PLN 150. The Guest must take proper care of the transponder received upon entry and use it only for its intended purpose as set out in the Regulations.
7. The Guest must fasten the transponder (data carrier) to their wrist in a way that prevents its loss and wear it in this manner for the entire duration of their stay on the Facility premises. The Guest must present the transponder at any request of the Facility Personnel.
8. Information terminals located on the Facility premises allow the Guest to check the current spending limit on the given transponder.
9. Any loss of a transponder must be reported immediately to the Facility Personnel. If a transponder is lost, a fee equal to the Guest’s actual outstanding balance will be charged, which may be determined on the basis of the receipt issued or other proof of ticket purchase. If it is not possible to verify the actual outstanding balance of the Guest, a fee equal to the maximum spending limit on the transponder applicable to the current offer and age category will be charged, increased by the cost of the lost transponder (PLN 80).
10. The transfer of a transponder to third parties is prohibited. If a transponder is made available to a third party, the Guest must pay for all services recorded on the transponder as if they had been used personally.
11. Payments for Wellness & Spa services purchased within the Facility, sauna sessions, catering services, and additional charges for exceeding the time limit are settled upon leaving the Facility, after the transponder has been returned.
§ 5. RULES FOR USING LOCKERS
1. These Regulations set out the rules for using:
a) lockers located in the changing room area of the Facility, not covered by monitoring, intended for storing personal items of low value,
b) deposit lockers located outside the changing rooms, covered by continuous monitoring, intended for storing valuables.
2. Lockers and deposit lockers located in the Facility are secured using a transponder (issued at the Facility reception).
3. Before using the services and attractions offered in the Zones, the Guest must change into appropriate swimwear and pool footwear and leave their other clothing, footwear, and belongings in a locker, which must be properly and securely locked by placing the transponder against it.
4. All personal items must be stored in lockers strictly in accordance with the rules set out below.
5. Lockers and deposit lockers are the only places on the Facility premises intended for storing belongings. The Operator is not responsible for items left by the Guest outside a locker or deposit locker, subject to the rules set out below.
6. Only items necessary for using the Facility may be stored in lockers, i.e. spare clothing, toiletries of average value, a towel, footwear of average value, etc. The Operator states that lockers in the changing room area are not intended for storing valuables and do not have security features that ensure the protection of valuable items.
7. Before leaving the changing room area, the Guest must check that the locker has been properly locked using the transponder. The Guest must exercise due care when locking the locker after placing their belongings inside; otherwise, the Facility Operator is not responsible for their loss or damage. If a locker does not function properly, the Guest must immediately inform the Facility Personnel; otherwise, the Facility Operator is not responsible for the loss or damage of items left inside.
8. All valuables (such as a phone, watch, cash, jewellery, documents, etc.) should be stored in deposit lockers located within the individual Zones of the Facility and covered by continuous monitoring. The Facility Operator states that deposit lockers are the only places on the Facility premises that provide sufficient security for storing valuables. If valuables are left outside a deposit locker, including in a standard locker, the Facility Operator is not responsible for their loss or damage.
9. After placing valuables in a deposit locker, the Guest must check that the deposit locker has been properly locked. The Guest must exercise due care when locking the deposit locker after placing their belongings inside; otherwise, the Facility Operator is not responsible for items left in the deposit locker. If a deposit locker does not function properly, the Guest must immediately inform the Facility Personnel; otherwise, the Facility Operator is not responsible for items left in the deposit locker.
10. After finishing using the Facility’s services, the locker and the deposit locker must be emptied and left open. The Facility Operator is not responsible for the loss or damage of items left in lockers or deposit lockers after the Guest has finished using the Facility’s services.
§ 6. GUEST RESPONSIBILITIES AND OBLIGATIONS
1. Before entering the Facility premises, the Guest must read these Regulations and undertakes to comply with them.
2. Each Zone, as well as the attractions and devices located on the Facility premises, has its own instructions and rules of use, which are made available within the Facility or displayed in a visible place near the relevant Zone, attraction, or device.
3. The following persons are not allowed to enter the Facility premises:
a) persons whose behaviour indicates that they are under the influence of alcohol, drugs, psychoactive substances, or other intoxicating agents,
b) persons disturbing public order, violating accepted standards of conduct, or posing a risk to themselves or others,
c) persons behaving aggressively,
d) persons under 13 years of age, unless under the supervision of a parent or another legal guardian,
e) persons with open wounds or skin infections,
f) persons whose behaviour poses a threat to their surroundings,
g) persons whose level of personal hygiene does not meet generally accepted standards.
4. The Facility Personnel are entitled to require the persons referred to in paragraph 3 above to leave the Facility immediately, without any right to claim a refund of the ticket price.
5. Guests are prohibited from creating situations that endanger the safety of other users, engaging in obscene, vulgar, or offensive behaviour towards other Guests or Facility Personnel, or disrupting organised activities and sports events.
6. Guests must also comply with these Regulations, prohibitions and requirements set out on boards and signs placed on the Facility premises, safety rules, and instructions of the Facility Personnel. In the event of failure to comply with the rules referred to in the previous sentence, the Facility Personnel are entitled to require the Guest to leave the Facility immediately, without any right to claim a refund of the ticket price.
7. Failure to comply with these Regulations, internal instructions, prohibitions and requirements, and safety rules may lead to accidents and may result in liability as provided for in these Regulations and in generally applicable law.
8. Before using attractions in the water zone, sauna and spa zone, gym zone, and fitness zone, the Guest must take a shower using cleansing products (also after using the toilet) and disinfect their feet using the dedicated disinfection devices located on the Facility premises.
9. Persons using the water zone must change into tight-fitting swimwear. For women, this means a one-piece or two-piece swimsuit; for men, swim shorts or swim briefs with a maximum length to mid-thigh. Entering the water in other clothing is not permitted, in particular in underwear, cycling shorts, gym shorts, or clothing that does not cover intimate body parts.
10. Children up to 3 years of age and other persons using diapers during their stay at the Facility must wear special swimming diapers designed for bathing.
11. All Guests are prohibited from engaging in activities that may endanger safety, peace, or order. These include, in particular:
a) using services and attractions after consuming alcohol, intoxicating substances, or other substances with similar effects, as well as bringing such substances onto the Facility premises,
b) consuming alcohol outside designated catering areas on the Facility premises,
c) bringing personal food and beverages onto the Facility premises,
d) bringing food storage devices, in particular portable coolers,
e) smoking tobacco or e-cigarettes, except in designated areas,
f) bringing animals onto the Facility premises,
g) remaining in areas closed to the public,
h) bringing any dangerous items onto the Facility premises, in particular glass containers, knives, and other sharp objects,
i) running,
j) polluting the water in any way,
k) using the Facility’s equipment and furnishings for purposes other than those intended; in the event of improper use, damage, or removal of equipment from its designated place, the Guest is responsible for the resulting damage,
l) engaging in behaviour that may cause embarrassment to others, in particular sexual activity or other conduct that may be considered indecent,
m) moving or placing loungers in a way that disrupts movement within the Facility premises, in particular by blocking emergency exits,
n) triggering false alarms.
12. Persons who, due to physical or mental disability, are not self-reliant or require supervision may remain on the Facility premises only in the presence of an adult guardian. This rule also applies to persons suffering from fainting, cramps, or epilepsy, as well as persons with cardiovascular diseases or other conditions that may pose a risk to their safety.
13. Persons present on the Facility premises who disturb public order, violate accepted standards of conduct and social coexistence—including those posing a threat to other persons on the Facility premises—or who fail to comply with these Regulations, other regulations applicable at the Facility, or instructions of the Lifeguard Service or Facility Personnel, may be removed from the Facility without the right to a refund of previously paid fees or other charges, with the obligation to settle any incurred liabilities, regardless of whether the matter is referred for judicial proceedings. If necessary, the Facility Personnel may call security services or the Police.
14. The Guest must use all devices and equipment of the Facility with due care, in accordance with their intended purpose and these Regulations.
15. The Guest must hand over to the Facility Personnel all found items and objects that do not belong to them.
16. The Guest must immediately inform the Facility Personnel of any situations that pose a risk to persons staying at the Facility.
17. The Guest should be aware that there is a risk of slipping on the Facility premises, in particular in areas near swimming pools and on water slides. For these reasons, the use of anti-slip footwear when moving around the Facility and exercising particular caution is recommended.
18. Using the outdoor pool in adverse weather conditions (e.g. storms, strong winds, heavy rain, hail, or other atmospheric phenomena) is prohibited.
19. The water, sauna, spa, and fitness zones must be vacated no later than 20 minutes before the closing time of the relevant zone, regardless of the time of entry, and Guests must proceed to the changing rooms.
20. Complaints/requests/opinions must be submitted by email via the contact form available on the website www.aqua-resort.pl response will be provided within 14 (fourteen) days from the date the complaint/request/opinion is received.
§ 7. RIGHTS OF THE FACILITY OPERATOR
1. The Facility Operator or Facility Staff have the right to refuse entry to the Facility or require persons who fail to comply with these Regulations to leave the Facility.
2. For reasons of safety and Guest comfort, persons who repeatedly violate the provisions of these Regulations or other instructions may be subject to a temporary or permanent ban from entering the Facility.
3. In the event of a serious breach of these Regulations, Facility security staff are entitled, within the limits of applicable law, to take measures provided for in the Act of 22 August 1997 on the Protection of Persons and Property in order to ensure safety. If a person is detained by Facility security staff in accordance with applicable regulations, that person will be immediately handed over to the police.
4. Facility Personnel exercise the so-called host’s rights of the Facility. Persons present on the Facility premises must comply with the instructions and orders of the Facility Personnel.
5. The Facility, excluding sanitary areas (changing rooms and toilets), is monitored for the purpose of improving Guest safety. By entering the Facility premises, the Guest consents to monitoring during their stay at the Facility and to the use of such recordings in the event of disputes. Monitoring is conducted in a manner that does not infringe the personal rights or dignity of the Guest and may be made available to authorities and institutions pursuant to generally applicable law.
6. Camera recordings are stored at the Facility and may be used to ensure safety at the Facility, including to hold persons who fail to comply with the applicable rules and Regulations accountable. The Facility Operator is the controller of the recordings. The Facility user has the right to access recordings to the extent relating to their image.
§ 8. RULES FOR USING THE WATER ZONE
1. The water zone of the Facility includes swimming pools (a recreational pool and an outdoor pool with a bar), water playgrounds, paddling pools, and jacuzzis.
2. The following sound signals used by lifeguards apply in the water zone:
a) a series of short sound signals (whistle) – ALARM – a call for all users to immediately leave the pool basin and follow further instructions of the lifeguards or Facility Personnel,
b) a long sound signal (whistle) – end of Facility operation – an order to leave the water immediately,
c) a short sound signal (whistle) – an order to pay attention to a lifeguard’s announcement.
3. All pool basins and water attractions are under the supervision of the Facility’s lifeguards. Parents or legal guardians are responsible for the direct supervision and care of children.
4. The following is prohibited:
a) jumping into pools,
b) hanging on ladders, bars, ropes, devices, or elements of the Facility’s equipment not intended for this purpose,
c) pushing or throwing other persons into the pool,
d) bringing baby strollers into the pool hall; strollers must be left in the main changing room in the designated area,
e) staying in the pool or outdoor tubs during atmospheric discharges,
f) entering the water against lifeguards’ instructions, in the absence of lifeguard supervision, or during rescue operations.
5. Guests using auxiliary swimming equipment or water recreation equipment must return it to the designated place after use.
6. Persons who damage equipment or devices located on the Facility premises are financially liable for the damage caused. Parents or legal guardians are responsible for damage caused by minors.
7. Water slides may be used only by healthy persons who are fully physically fit and able to swim.
8. The Guest must use water slides and pool basins in accordance with their instructions, these Regulations, and solely for their intended purpose.
9. Water slides are sports equipment, and their use involves specific risks related to physical activity, which the Guest accepts by deciding to use the slides. Accordingly, there is a risk of bodily injury or harm, even when using equipment that is tested and maintained in accordance with applicable standards and when following the instructions displayed on information boards.
10. Guests must comply with safety instructions and information posted on information boards.
11. The use of slides by persons whose height or body weight does not fall within the limits specified on information boards, or contrary to instructions given by Facility Personnel, is prohibited and may result in an accident.
12. A slide may be used by the next Guest only after the previous Guest has cleared the slide area.
13. Guests must leave the slide exit area immediately after completing the slide.
14. In the slide and pool basin areas, children under 13 years of age must remain under the constant supervision of a parent or legal guardian.
15. Guests using water slides must ensure that they do not create situations posing a risk to themselves or other Guests using the slides; in particular, the following is prohibited:
a) adopting a sliding position other than that indicated in the instructions,
b) turning forwards or backwards during the slide,
c) sliding together with other Guests at the same time,
d) stopping in the sliding area or slide exit area,
e) climbing up the slide from the bottom,
f) standing inside the slide,
g) running on the stairs leading to the slide,
h) sliding while wearing jewellery, watches of any kind, necklaces, or video recording cameras.
16. Before using the attractions, Guests are advised to remove prescription glasses, swimming goggles, diving masks, watches, chains, earrings, and similar items that may cause cuts or other injuries or damage the slide, and to leave them in lockers or deposit lockers.
17. Wearing glasses or contact lenses is at the Guest’s own risk. If prescription glasses are worn on the Facility premises, they must be secured in a way that prevents them from falling off.
§ 9. RULES FOR USING THE SAUNA ZONE
1. Use of the sauna zone is permitted only for persons over 17 years of age and in good health. By entering the sauna zone, the Guest confirms that their health condition allows them to use this form of recreation.
2. Access to the saunas is prohibited in particular for persons:
a) under the influence of alcohol, under the influence of psychoactive substances or other intoxicating agents,
b) with infectious skin diseases,
c) with infections,
d) with viral (e.g. influenza) or bacterial infections,
e) with tuberculosis,
f) with conditions involving sudden attacks, such as epilepsy,
g) during the first three months following a stroke,
h) with inflammation of the veins,
i) with disorders of the circulatory system.
IMPORTANT: women during menstruation and pregnant women should not use saunas or steam baths, as this may pose a risk to their health.
3. Each Guest using the sauna zone must have flip-flops, a towel, or a pareo. The sauna zone is a textile-free area. This means that persons entering this area must remove their swimwear and cover themselves with a towel. Remaining naked in communication areas and relaxation zones is prohibited. Being naked is permitted in sauna cabins and steam baths, provided that intimate areas are covered. Flip-flops and bathrobes must be left outside the sauna or steam bath cabin. For hygiene reasons, the entire body, including the feet, must be placed on a towel in the sauna so that no part of the body comes into direct contact with the wooden surfaces.
4. Bringing in and using mobile phones and recording devices in the sauna area is prohibited.
5. Only Facility Personnel may operate the saunas and the equipment located within them.
6. The use of any personal liquids, emulsions, oils, or other substances in steam baths or saunas is prohibited, as is touching the heat supply installations.
7. Placing any objects (e.g. towels, pareos) near or on the heater is prohibited.
8. Bringing in and consuming personal food in the sauna zone is prohibited.
9. To ensure hygiene, the Guest must take a shower before entering the sauna and after using it. Before entering the sauna, all metal jewellery (e.g. gold, silver) must be removed.
10. Sauna sessions may be conducted only by authorised persons. Rules for participation in sauna ceremonies, special sessions, and sauna evenings:
a) sauna ceremony – a treatment in a dry sauna using specially prepared aromatic substances (e.g. oils, concentrates, resins), conducted by a sauna master who distributes steam and warm air throughout the sauna cabin. Participation in a ceremony depends on the order of entry,
b) special ceremonies – an advanced treatment in a dry sauna or steam bath using specially prepared aromatic substances (oils, concentrates, resins), conducted by a sauna master who distributes steam and warm air throughout the sauna cabin, with the additional use of cosmetic products. The session is subject to an additional fee,
c) sauna evenings – a type of several-hour sauna ceremony conducted by a sauna master, who ensures the comfort and safety of participants. Sauna evenings are themed; therefore, during the dry sauna ceremony, the sauna master presents stories related to the main theme of the event. Additionally, between steam bath sessions, Guests may use body scrubs and cosmetic products. During sauna evenings, snacks prepared by the Facility Personnel are also available to Guests. Duration of a sauna evening – up to 4 (four) hours. Sauna evenings are events for adults only. Limited number of places; prior reservation is required.
§ 10. RULES FOR USING THE GYM ZONE
1. Use of the gym is permitted after familiarising oneself with these Regulations.
2. The gym is open daily from 10:00 a.m. to 9:00 p.m.
3. The gym is available to hotel Guests as part of the fee paid for their stay and only during the paid hotel day, and to external users after prior payment of the fee specified in the Price List.
4. The right to use the gym is granted to Guests and individual clients who are at least 17 years of age.
5. Sports attire and clean indoor sports footwear are required in the gym.
6. Before starting a workout, the Guest must disinfect their hands using the disinfectant provided.
7. Bringing in and consuming food and beverages is prohibited, except for water.
8. The following is prohibited in the gym area:
a) running (this does not apply to treadmills),
b) using equipment and training devices in a manner inconsistent with their intended purpose,
c) bringing in items that pose a risk to users’ health (in particular sharp tools, glass containers, cans, etc.),
d) entering or remaining in the gym by persons under the influence of alcohol or intoxicating or psychoactive substances,
e) damaging gym equipment,
f) littering or contaminating the premises,
g) smoking tobacco,
h) bringing in items that obstruct movement within the Facility.
9. After each use, the Guest must wipe down training equipment using the disposable towels and disinfectant available in the gym.
10. Guests must use the rooms, devices, and equipment provided in the fitness zone in accordance with their intended purpose. The Operator is not responsible for damage caused by the Guest and attributable to the Guest’s actions, in particular resulting from using equipment in a manner inconsistent with its intended purpose, including contrary to operating instructions or instructions given by Facility Personnel.
11. Guests are responsible for any damage to training equipment and machines caused by their fault, in particular resulting from the Guest’s failure to familiarise themselves with the operating instructions for the equipment or machines, or from improper use.
§ 11. RULES FOR USING THE FITNESS ZONE
1. The Fitness Zone (group classes) is an integral part of the Aquapark Facility, and the provisions of the General Facility Regulations as well as these Regulations apply to it.
2. Group classes are held in accordance with the approved schedule.
3. The fitness zone may be used by persons who are at least 17 years of age, hold a valid admission ticket or pass, and have familiarised themselves with these Regulations.
4. Persons participating in group classes declare that they have no health contraindications to performing physical exercise and participate at their own risk. Persons with health issues should consult a doctor before starting exercise.
5. A strict prohibition applies in the fitness zone on smoking tobacco or electronic cigarettes, consuming alcohol, using intoxicating substances or drugs, and selling any pharmaceuticals. Persons who fail to comply with the above provisions may be required to leave the Facility; in such cases, they are not entitled to claim a refund for the purchased ticket or pass.
6. Persons exercising during organised classes bear full responsibility for any damage caused by them in the fitness rooms. For any damage to property located in the fitness rooms and for any intentional actions to the detriment of the fitness zone, the Client shall be legally and financially liable.
7. Entry to organised classes is permitted only in appropriate, complete sports attire and clean, changed sports footwear.
8. The instructor has the right to refuse entry to classes to persons without appropriate sports attire, in particular clean, changed sports footwear.
9. Entry to the fitness zone is granted on the basis of an ESOK transponder.
10. A class reservation system applies in the fitness zone.
11. Persons holding a ticket or pass who have reserved a place in selected fitness classes must report to reception no later than 10 minutes before the class begins. If a person fails to report to reception, their reservation will be forfeited in favour of a waiting person.
12. A reserved class may be cancelled no later than 4 hours before the scheduled start time, and in the case of morning and late-morning classes, by 8:00 p.m. on the preceding day.
13. The Facility Staff reserve the right to change the date or instructor of a given class, as well as to cancel scheduled classes (with appropriate advance notice).
§ 12. RULES FOR USING THE SPA ZONE
1. Before using the spa zone, each Guest should familiarise themselves with the regulations available at the reception. Use of the services constitutes acceptance of these Regulations.
2. Guests are advised to book treatments several days in advance.
3. Guests are advised to arrive at least 10 minutes before the scheduled start of the treatment. If a Guest arrives late, the treatment may be shortened without any reduction in price. In the event of late arrival, the Facility Personnel have the right to refuse to perform the treatment.
4. To book a treatment, the Guest must provide their first and last name, room number, or contact telephone number.
5. The SPA zone is intended for relaxation and rest. For this reason, silence must be observed in the SPA zone and the use of mobile phones is prohibited.
6. If a Guest wishes to cancel or change a treatment appointment, the Spa Reception must be informed.
7. Use of SPA zone services requires prior completion and signing of a health questionnaire. This is equivalent to the Guest declaring that they have no health contraindications to the treatment and that they have read and accepted the terms of these Regulations. If any contraindications to a treatment are identified, the Facility Personnel may refuse to perform the treatment.
8. The Operator reserves the right to refuse entry to persons under the influence of alcohol, psychoactive substances, or other intoxicating agents, and to interrupt a treatment in the event of inappropriate behaviour by the Guest.
9. Guests using SPA zone services settle payment for the services directly at the SPA Reception immediately after the treatment has been completed.
